How the market works

  • Deposit (fianza): 1 to 2 months' rent. Legally limited to 2 months for residential rentals.
  • Agency fee (honorarios): up to 1 month's rent plus VAT, paid by the tenant. As of 2023, the Ley de Vivienda made this ILLEGAL, the landlord must pay. In practice agencies still try to charge tenants, push back hard.
  • Contracts: minimum 12 months, though student-friendly landlords do 6- or 9-month leases
  • Bills (suministros): usually NOT included. Add €60 to €130/month for electricity, gas, water, internet

Key paperwork

  • NIE (Número de Identidad de Extranjero): foreigner ID number, required for any rental contract, bank account, or utility connection. Get it at the Spanish consulate before arrival or at a Policía Nacional office after arrival.
  • Padrón municipal: city residence registration. Required for health coverage, voting, library access, NIE renewal. Register within 3 months of moving in at your local Ayuntamiento.
  • TIE (Tarjeta de Identidad de Extranjero): the physical card for non-EU students, issued after NIE + visa registration

Common mistakes

  • Paying agency fees when the landlord is legally required to pay
  • Signing before getting your NIE (contract may be unenforceable)

  • Not checking whether a "pisos compartidos" listing is fully legal (some are informal sublets)
  • Not reading the contract carefully, many have a "permanencia" clause requiring you to stay the full term or pay a penalty
