1. Agreement to Terms

By accessing or using the website www.socials.homes, our student accommodation matching service (“Socials Housing”), and related services (collectively, the “Services”) operated by Socials BV (“Socials”, “we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you may not use our Services.

2. Description of Services

Socials provides a platform for exchange and international students that includes:

  • Socials Housing: A student accommodation matching service that curates verified housing listings from trusted housing providers and landlords and delivers them to subscribers via WhatsApp, together with exclusive discount codes

Important: Socials is NOT a student accommodation provider, landlord, property manager, or booking platform. We curate and recommend listings from third-party housing providers and landlords. All bookings are made directly between you and the housing provider. We are not a party to any rental or accommodation agreement you enter into.


3. Eligibility and Account Registration

3.1 Eligibility

To use our Services, you must:

  • Be at least 18 years old
  • Be a current or prospective student (including exchange students, international students, Erasmus students, or students undertaking internships abroad)
  • Have a valid WhatsApp account to receive accommodation listings
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete registration information

3.2 Account Information

You are responsible for:

  • Maintaining the confidentiality of your account information
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your registration information remains accurate and current
  • Providing a valid WhatsApp number capable of receiving messages

4. Subscription and Payment

4.1 Paid Plans

We offer paid subscription plans for Socials Housing. Current pricing is displayed on our website and may be updated from time to time. Any price changes will apply to new subscriptions only and will not affect existing active subscriptions.

4.2 Payment

  • All payments are processed securely through our payment provider, Stripe
  • Payment is charged in full at the time of purchase
  • By providing payment information, you represent that you are authorised to use the payment method and that the information is accurate
  • All prices are in Euros (€) and inclusive of VAT where applicable

4.3 What Your Subscription Includes

  • Curated student accommodation listings delivered to your WhatsApp, matched to your city, budget, and move-in date
  • Exclusive discount codes for housing providers and landlords
  • Customer support via WhatsApp and email

4.4 What Your Subscription Does NOT Include

  • Guaranteed housing placement or booking confirmation
  • Direct booking capability — all bookings are made on the housing provider's website
  • Guaranteed availability of any specific listing
  • Accommodation itself — we are a matching and referral service, not a housing provider

5. Refund Policy and Satisfaction Guarantee

5.1 Satisfaction Guarantee

If you are not satisfied with our Services, you may request a full refund within 14 days of your initial payment. To request a refund, contact us at help@socials.homes with your account email and reason for the request. Refunds will be processed to your original payment method within 14 business days.

5.2 Free Extension Policy

If you have not found accommodation by the end of your subscription period, you may request a free extension. To request an extension, contact us at help@socials.homes before or within 7 days after your plan expires. Extensions are granted at our discretion and are limited to one extension per subscription.

5.3 No Refund After 14 Days

After the initial 14-day satisfaction period, subscriptions are non-refundable. Since our Services are delivered digitally and immediately upon activation, the EU right of withdrawal does not apply once the delivery of accommodation listings has commenced with your explicit prior consent (Article 16(m), Directive 2011/83/EU). By subscribing and activating your account, you acknowledge and consent to this.

5.4 Chargebacks

If you initiate a chargeback through your bank or credit card provider instead of contacting us directly, we reserve the right to suspend your account and pursue any amounts owed. We encourage you to contact us first at help@socials.homes so we can resolve any issues promptly.


6. Discount Codes

6.1 Usage

As part of your subscription, you will receive exclusive discount codes for use on housing provider platforms. These codes:

  • Are for personal use only and may not be shared publicly, sold, or redistributed
  • Are subject to the terms and conditions of the respective housing provider
  • May have expiry dates or usage limitations set by the provider
  • May be changed, updated, or discontinued at any time
  • Cannot be combined with other promotions unless stated otherwise by the provider

6.2 Savings Disclaimer

Savings amounts referenced on our website are estimates based on typical booking values and discount code percentages. Actual savings depend on the specific listing, housing provider, booking value, and applicable terms. We do not guarantee a specific minimum savings amount.


7. Accommodation Listings

7.1 Listing Accuracy

We curate listings from trusted housing providers and landlords, but we do not verify individual listings ourselves. We rely on our partners' own verification processes. We are not responsible for:

  • The accuracy, completeness, or timeliness of any listing information
  • The availability of any specific property
  • The condition of any property
  • Changes to pricing, availability, or terms after a listing is delivered to you
  • Any dispute between you and a housing provider or landlord

7.2 Booking Responsibility

When you click through to a housing provider and make a booking, you enter into a direct agreement with that provider and/or the landlord. Socials is not a party to that agreement. You are responsible for:

  • Reading and accepting the housing provider's terms and conditions
  • Verifying listing details before booking
  • Understanding cancellation and refund policies of the housing provider
  • All payments made to the housing provider
  • Any disputes with the housing provider or landlord

7.3 Affiliate Relationship

Socials earns referral commissions from housing providers when subscribers book accommodation through our tracked links. This affiliate relationship does not increase the cost you pay for accommodation. Discount codes provided to Socials members reduce your costs below the standard price.


8. User Conduct and Obligations

8.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation
  • Share false, misleading, or fraudulent information
  • Harass, abuse, or harm other users
  • Send spam, unsolicited messages, or commercial communications
  • Use our Services for any illegal or unauthorized purpose
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Collect or harvest personal information of other users
  • Use automated scripts or bots to interact with the Services
  • Share, resell, or redistribute your subscription access, discount codes, or accommodation listings to non-subscribers

9. Intellectual Property Rights

9.1 Our Content

All content on our Services, including but not limited to text, graphics, logos, images, curated listing compilations, software, and compilation thereof (“Content”), is the property of Socials BV or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

9.3 User Content

By submitting any content to our Services (including reviews or feedback), you:

  • Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in connection with our Services
  • Represent and warrant that you have all necessary rights to grant this license
  • Agree that you are solely responsible for any content you submit

10. Third-Party Services and Links

10.1 Housing Providers

The housing providers accessible through our Services are operated independently by third parties. We do not control, endorse, or assume responsibility for:

  • The content, availability, or accuracy of listings on housing provider platforms
  • The policies, practices, or terms of housing providers
  • The quality of accommodation provided by landlords or property managers
  • Any transactions between you and housing providers

10.2 WhatsApp

Our Services use WhatsApp as a delivery channel. Your use of WhatsApp is subject to WhatsApp's own Terms of Service and Privacy Policy. We are not responsible for WhatsApp's policies, service availability, or data handling practices.


11. Privacy and Data Protection

Your use of our Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding personal data collection and use.


12. Disclaimers

12.1 Service Availability

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of accommodation listings.

12.2 No Guarantee of Results

We do not guarantee that you will find suitable accommodation through our Services, a specific number of listings during your subscription, the availability or accuracy of any specific listing, or uninterrupted operation of the Services.

12.3 Accommodation Disclaimer

Socials does not own, manage, inspect, or control any accommodation listed through our Services. All listings are sourced from third-party housing providers and landlords. We do not verify the physical condition of properties. Any complaints about accommodation quality, condition, or landlord behaviour must be directed to the relevant housing provider or landlord.


13. Limitation of Liability

13.1 Exclusion of Damages

To the maximum extent permitted by law, Socials BV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, whether arising from your use of the Services, any accommodation booking or rental agreement, or any third-party services or content.

13.2 Maximum Liability

In no event shall our total liability exceed the greater of: (a) the amount you paid us for your current subscription, or (b) €100.

13.3 Exceptions

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.


14. Indemnification

You agree to indemnify, defend, and hold harmless Socials BV, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or connected with your use of the Services, your violation of these Terms, any accommodation booking or rental agreement you enter into, or any content you submit to the Services.


15. Termination

15.1 By You

You may stop using our Services at any time. You may request deletion of your account by contacting us at help@socials.homes. Terminating your account does not entitle you to a refund outside the satisfaction guarantee period.

15.2 By Us

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including but not limited to:

  • Violation of these Terms
  • Sharing or redistributing your subscription benefits
  • Conduct harmful to other users
  • Non-payment

15.3 Effect of Termination

Upon termination, your right to use the Services and receive accommodation listings will immediately cease. Discount codes will be deactivated.


16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the “Last Updated” date. Your continued use of the Services after any changes constitutes acceptance of the modified Terms.


17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

17.2 Jurisdiction

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium.

17.3 Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute through good faith negotiation by contacting us at help@socials.homes. We aim to respond to and resolve complaints within 30 days.


18. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Socials BV regarding the use of our Services. If any provision is found to be unenforceable, the remaining provisions remain in full force. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

20. Consumer Rights (EU Specific)

20.1 Right of Withdrawal

Since our paid Services consist of digital content and services delivered immediately upon activation, you expressly consent to the commencement of service delivery before the expiry of the 14-day withdrawal period. By subscribing and verifying your account, you acknowledge that you lose your right of withdrawal once listing delivery has begun, in accordance with Article 16(m) of Directive 2011/83/EU. However, we voluntarily offer a 14-day satisfaction guarantee as described in Section 5.1.
